Upcoming Public Hearings, and Regular Meeting

The Board of Supervisors (“Board”) for the River Glen Community Development District (“District”) will hold the following two public hearings and a regular meeting:

It is anticipated that the public hearings and meeting will take place at the location above. In the event that the COVID-19 public health emergency prevents the hearing and meeting from occurring in-person, the District may conduct the public hearing by telephone or video conferencing communications media technology pursuant to governmental orders, including but not limited to Executive Orders 20-52, 20-69, 20-123 and 20-150 issued by Governor DeSantis, and any extensions or supplements thereof, and pursuant to Section 120.54(5)(b)2., Florida Statutes.  

While it may be necessary to hold the above referenced public hearing and meeting utilizing communications media technology due to the current COVID-19 public health emergency, the District fully encourages public participation in a safe and efficient manner.  To that end, anyone wishing to listen to and/or participate in the Meeting can do so by Teleconference Number 1-929-205-6099 Meeting ID: 680 626 4765. The first public hearing is being held pursuant to Chapter 190, Florida Statutes, to receive public comment and objections on the District’s proposed budget (“Proposed Budget”) for the fiscal year beginning October 1, 2020 and ending September 30, 2021 (“Fiscal Year 2020/2021”). The second public hearing is being held pursuant to Chapters 190 and 197, Florida Statutes, to consider the imposition of operations and maintenance special assessments (“O&M Assessments”) upon the lands located within the District, to fund the Proposed Budget for Fiscal Year 2020/2021; to consider the adoption of an assessment roll; and, to provide for the levy, collection, and enforcement of assessments. At the conclusion of the hearings, the Board will, by resolution, adopt a budget and levy O&M Assessments as finally approved by the Board. A Board meeting of the District will also be held where the Board may consider any other District business.

Description of Assessments

The District imposes O&M Assessments on benefitted property within the District for the purpose of funding the District’s general administrative, operations, and maintenance budget. A geographic depiction of the property potentially subject to the proposed O&M Assessments is identified in the map attached hereto.  The table below shows the schedule of the proposed O&M Assessments, which are subject to change at the hearing:

 

The proposed O&M Assessments as stated include collection costs and/or early payment discounts, which Nassau County (“County”) may impose on assessments that are collected on the County tax bill.  Moreover, pursuant to Section 197.3632(4), Florida Statutes, the lien amount shall serve as the “maximum rate” authorized by law for O&M Assessments, such that no assessment hearing shall be held or notice provided in future years unless the assessments are proposed to be increased or another criterion within Section 197.3632(4), Florida Statutes, is met. Note that the O&M Assessments do not include any debt service assessments previously levied by the District and due to be collected for Fiscal Year 2020/2021.  

For Fiscal Year 2020/2021, the District intends to have the County tax collector collect the assessments imposed on certain developed property and will directly collect the assessments imposed on the remaining benefitted property by sending out a bill prior to, or during, November 2020.  It is important to pay your assessment because failure to pay will cause a tax certificate to be issued against the property which may result in loss of title, or for direct billed assessments, may result in a foreclosure action, which also may result in a loss of title.  The District’s decision to collect assessments on the tax roll or by direct billing does not preclude the District from later electing to collect those or other assessments in a different manner at a future time.

The public hearings and meeting are open to the public and will be conducted in accordance with the provisions of Florida law.  A copy of the Proposed Budget, proposed assessment roll, and the agenda for the hearings and meeting may be obtained at the offices of the District Manager, located at Rizzetta & Company, Inc., at 2806 North Fifth Street, Suite 403, St. Augustine, Florida, 32084 Ph: (904) 436-6270 (“District Manager’s Office”), during normal business hours.  The public hearings and meeting may be continued to a date, time, and place to be specified on the record at the hearings or meeting.  There may be occasions when staff or board members may participate by speaker telephone.

Request for Qualifications (“RFQ”) 

FOR Engineering Services FOR THE 

AMELIA CONCOURSE Community Development District

The Amelia Concourse Community Development District (“District”), located in Nassau County, Florida, announces that professional engineering services will be required on a continuing basis for the District.  The engineering firm selected will act in the general capacity of District Engineer and, if so authorized, may provide general engineering services as well as engineering services on an ongoing basis and for the design and construction administration associated with the District’s capital improvement plan.  The District may select one or more engineering firms to provide engineering services on an ongoing basis.

Any firm or individual (“Applicant”) desiring to provide professional services to the District must: 1) hold applicable federal, state and local licenses; 2) be authorized to do business in Florida in accordance with Florida law; and 3) furnish a statement (“Qualification Statement”) of its qualifications and past experience on U.S. General Service Administration’s “Architect-Engineer Qualifications, Standard Form No. 330,” with pertinent supporting data.  Among other things, Applicants must submit information relating to: a) the ability and adequacy of the Applicant’s professional personnel; b) whether the Applicant is a certified minority business enterprise; c) the Applicant’s willingness to meet time and budget requirements; d) the Applicant’s past experience and performance, including but not limited to past experience as a District Engineer for any community development districts and past experience with Nassau County; e) the geographic location of the Applicant’s headquarters and offices; f) the current and projected workloads of the Applicant; and g) the volume of work previously awarded to the Applicant by the District.  Further, each Applicant must identify the specific individual affiliated with the Applicant who would be handling District meetings, construction services, and other engineering tasks.

The District will review all Applicants and will comply with Florida law, including the Consultant’s Competitive Negotiations Act, Chapter 287, Florida Statutes (“CCNA”).  All Applicants must submit five (5) originals and one electronic version of Standard Form No. 330 and Qualification Statement by 3:00 p.m. on Thursday, August 6, 2020 and to the attention of Governmental Management Services (c/o Daniel Laughlin) 475 West Town Place, Suite 114, St. Augustine, Florida 32092; Ph: (904) 940-5850 (“District Manager’s Office”).  

The Board of Supervisors shall select and rank the Applicants using the requirements set forth in the CCNA and the evaluation criteria on file with the District Manager’s Office, and the highest ranked Applicant will be requested to enter into contract negotiations.  If an agreement cannot be reached between the District and the highest ranked Applicant, negotiations will cease and begin with the next highest ranked Applicant, and if these negotiations are unsuccessful, will continue to the third highest ranked Applicant.  The District reserves the right to reject any and all Qualification Statements.  Additionally, there is no express or implied obligation for the District to reimburse Applicants for any expenses associated with the preparation and submittal of the Qualification Statements in response to this request. 

Any protest regarding the terms of this Notice, or the evaluation criteria on file with the District Manager’s Office, must be filed in writing with the District Manager’s Office, within seventy-two (72) hours after the publication of this Notice.  The formal protest setting forth with particularity the facts and law upon which the protest is based shall be filed within seven (7) calendar days after the initial notice of protest was filed.  Failure to timely file a notice of protest or failure to timely file a formal written protest shall constitute a waiver of any right to object or protest with respect to aforesaid Notice or evaluation criteria provisions.  Any person who files a notice of protest shall provide to the District, simultaneous with the filing of the notice, a protest bond with a responsible surety to be approved by the District and in the amount of Ten Thousand Dollars ($10,000.00).

CANVASSING BOARD FOR

THE AUGUST 18, 2020

PRIMARY ELECTION

All meetings of the Nassau County Canvassing Board (Canvassing Board) are open to the public and will be conducted at the James S. Page Governmental Complex in the Canvassing Board Room located at 96135 Nassau Place, Yulee, Florida 32097.  Public inspections of sealed VBM ballots will be held in the Supervisor of Elections Office located in Suite 3 in the Complex.

The Canvassing Board will convene at 1:00 p.m. on July 22, 2020 for the public pre-election testing of the automatic voting tabulation equipment to be used in the August 18, 2020 Primary Election and to perform any other duties as prescribed by law. 

Sealed Vote by Mail (VbM) ballots received prior to 3:30 p.m. on August 4, 2020 will be available for public inspection from 4:00 p.m. - 4:30 p.m. on August 4, 2020.  Those VbM ballots will be canvassed, opened and tabulated at the Canvassing Board meeting to convene at 8:30 a.m. on August 5, 2020; however, the results will not be generated at that time. 

Sealed Vote by Mail ballots received prior to 3:30 p.m. on August 11, 2020 will be available for public inspection from 4:00 p.m. - 4:30 p.m. on August 11, 2020.  Those VbM ballots will be canvassed, opened and tabulated at the Canvassing Board meeting to convene at 8:30 a.m. on August 12, 2020; however, the results will not be generated at that time. 

Sealed VbM ballots received prior to 11:00 a.m. on August 16, 2020 will be available for public inspection from 11:30 a.m. - 12 noon.  Afterwards, those VbM ballots will be canvassed, opened and tabulated at the Canvassing Board meeting to convene at 1:00 p.m. on August 16, 2020; however, the results will not be generated at that time. 

Sealed VbM ballots received on or after 11:00 a.m. on August 16, 2020 through 1:00 p.m. on August 18, 2020 will be available for public inspection from 1:30 p.m. - 2:00 p.m. on August 18, 2020.

Persons wishing to inspect sealed VbM ballots received after 1:00 p.m. on August 18, 2020 through 7:00 p.m. on August 18, 2020 must be present during the Canvassing Board meeting, until the last VbM ballot is presented for canvassing on August 18, 2020. Those ballots will be canvassed, opened and tabulated throughout the Canvassing Board meeting to convene at 3:00 p.m. on August 18, 2020; however, the results will not be generated at that time. The results of the VbM ballots, early voting, provisional ballots, and precinct results will be generated after 7:00 p.m. on August 18, 2020.

The Canvassing Board will convene at 3:00 p.m. on August 20, 2020 to canvass, open and tabulate any remaining provisional ballots, cure affidavits for provisional ballots and VbM ballots, if necessary, certify the unofficial results, and perform any other duties as prescribed by law for the August 18, 2020 Primary Election.

The Canvassing Board will convene at 9:00 a.m. on August 22, 2020 to conduct any recount(s) ordered for the August 18, 2020 Primary Election and certify the 2nd Unofficial Results.  This meeting will only be held if recount(s) are ordered.

The Canvassing Board will convene at 1:00 p.m. on August 24, 2020 to certify official results and conduct of election report, conduct the post-election audit of the voting system and perform any other duties as prescribed by law. 

If it becomes necessary for the Canvassing Board to suspend or recess a meeting publicly noticed for a period lasting more than 60 minutes, a notice will be posted at www.VoteNassau.com with the anticipated time and date at which the board expects to reconvene.  If the Board does not reconvene at the specified time, the board will provide at least 2 hours’ notice, which will be posted on www.VoteNassau.com, before reconvening. 

Section 101.68(2)’(c)4, Florida Statutes, provides if any elector or candidate present believes that a VbM ballot is illegal due to a defect apparent on the voter’s certificate or the cure affidavit, he or she may, at any time before the ballot is removed from the envelope, file with the canvassing board a protest against the canvass of that ballot, specifying the precinct, the ballot, and the reason he or she believes the ballot to be illegal. A challenge based upon a defect in the voter’s certificate or cure affidavit may not be accepted after the ballot has been removed from the mailing envelope.

In accordance with the Sunshine Law of Florida, all Canvassing Board meetings are open to the public.

Section 286.0105, Florida Statutes, provides that if a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
