NOTICE OF RULEMAKING BY THE EAST NASSAU
STEWARDSHIP DISTRICT
A public hearing will be conducted by the Board of Supervisors of the East Nassau Stewardship District (the District) on June 25, 2025, at 11:00 a.m. EST, at Florida State College at Jacksonville, Nassau Center, Building T, Nassau Room (T126), 76346 William Burgess Boulevard, Yulee, Florida 32097.
In accordance with Chapter 120, Florida Statutes, and Chapter 2017-206, Laws of Florida, the District hereby gives the public notice of its intent to adopt a policy to address property owners requests to place fences within District easements located on resident lots (Fence Encroachment Policy). Prior Notice of Rule Development was published on May 14, 2025.
A copy of the proposed Fence Encroachment Policy may be obtained by contacting the District Managers Office at c/o Wrathell Hunt and Associates, 2300 Glades Road, Suite 410W, Boca Raton, Florida 33431, or by calling (561) 571-0010 (hereinafter, the District Office).
The proposed Fence Encroachment Policy includes a review fee in the amount to not exceed $1,000 to cover staff review plus actual recording fees. The proposed fees may be adjusted at the public hearing pursuant to discussion by the Board of Supervisors and public comment. The purpose and effect of the Fence Encroachment Policy is to provide for efficient and effective District operations of the Districts stormwater facilities and to implement the provisions of Section 6 of the Act. Specific legal authority for the District to adopt the proposed Fence Encroachment Policy includes Section 6, Subsections (6)(e) and (20)(b) of the Act, and Sections 120.54 and 120.81, of the Florida Statutes.
Any person who wishes to provide the District with a proposal for a lower cost regulatory alternative as provided by Section 120.541(1), Florida Statutes, must do so in writing within twenty-one (21) days after publication of this notice.
The public hearing may be continued to a date, time, and place to be specified on the record at the hearing. If anyone chooses to appeal any decision of the Board with respect to any matter considered at the public hearing, such person will need a record of the proceedings and should accordingly ensure that a verbatim record of the proceedings is made which includes the testimony and evidence upon which such appeal is to be based. At the hearing, staff or Supervisors may participate in the public hearing by speaker telephone.

Each person who decides to appeal any decision made by the Board with respect to any matter considered at the Meetings is advised that person will need a record of proceedings and that accordingly, the person may need to ensure that a verbatim record of the proceedings is made, including the testimony and evidence upon which such appeal is to be based.
