The Board of Supervisors (Board) of the Three Rivers Community Development District (District) will hold a Regular Meeting on June 30, 2022 at 9:00 a.m., at The Lookout Amenity Center, 76183 Tributary Drive, Yulee, Florida 32097.  The purpose of the meeting is for the Board to consider any business which may properly come before it.

PUBLIC NOTICE

This public notice is to solicit Pre-Qualification applications from General Contractors as per the State Requirements for Educational Facilities (SREF, 2014), Chapter 4.1 (1)(a) and Nassau County School District Administrative Rule 7.68 as follows:

(1) Pre-qualification of General Contractors for Educational Facilities Construction.  A Board shall pre-qualify contractors for a certain period or for a specific project.  The intent of this section is to prescribe uniform requirements for pre-qualification of contractors.

(a) Criteria.  Contractors shall be pre-qualified by a board on the basis of the following criteria and such other criteria as the board may adopt.

1. Proof that the contractor holds a contractors license, which authorizes the contractor to supervise the work within the scope of the construction project.

2. Evidence that the applicant has financial resources to start up and follow through on projects and to respond to damages in case of default as shown by written verification of bonding capacity equal to or exceeding the amount of any project for which the contractor seeks pre-qualification.  The written verification must be submitted by a licensed surety company rated excellent (A- or better) in the current A.M. Best Guide and qualified to do business within the state.  In the absence of such written verification, the board may require the applicant to submit any audited financial information necessary to evaluate an applicants financial ability to perform the project and to respond to damages in the event of default.

3. Evidence of experience with construction techniques, trade standards, quality workmanship, project scheduling, cost control, management of projects, and building codes for similar or less cost or scope projects as shown by the successful completion within the past five (5) years of at least two (2) other projects of similar size.

4. Evidence of satisfactory resolution of claims filed by or against the contractor asserted on projects of the same or similar size within the five (5) years preceding the submission of the application.  Any claim against a contractor shall be deemed to have been satisfactorily resolved if final judgment is rendered in favor of the contractor or any final judgment rendered against the contractor is satisfied within ninety (90) days of the date the judgment becomes final.

5. Type of work for which the contractor is licensed.  Evidence of timely completion of projects of similar scope and size.  Include any liquidated damages that may have been or could have been assessed on these projects.

The School Board of Nassau County is calling for proposals for PRE-QUALIFYING OF GENERAL CONTRACTORS for the purpose of bidding on FBHS HVAC System Mechanical Retrofit Phase II.

PROJECT: This project includes demolition and replacing of HVAC systems and removal, modification and re-installation of HVAC controls and other ancillary systems required to support the HVAC and control replacement in various buildings throughout the school campus.

AMELIA NATIONAL COMMUNITY DEVELOPMENT

DISTRICT REQUEST FOR PROPOSALS

FOR ANNUAL AUDIT SERVICES

The Amelia National Community Development District hereby requests proposals for annual financial auditing services. The proposal must provide for the auditing of the District’s financial records for the fiscal year ending September 30, 2022, with an option for four (4) additional annual renewals. The District is a local unit of special-purpose government created under Chapter 190, Florida Statutes, for the purpose of financing, constructing, and maintaining public infrastructure. The District is located in Nassau County and has an operating budget of approximately $281,295.00. The final contract will require that, among other things, the audit for Fiscal Year 2022 be completed no later than June 1, 2023.

Each auditing entity submitting a proposal must be authorized to do business in Florida; hold all applicable state and federal professional licenses in good standing, including but not limited to a license under Chapter 473, Florida Statutes; and be qualified to conduct audits in accordance with “Government Auditing Standards,” as adopted by the Florida Board of Accountancy. Audits shall be conducted in accordance with Florida law and particularly Section 218.39, Florida Statutes, and the rules of the Florida Auditor General.

Proposal packages, which include additional qualification requirements, evaluation criteria and instructions to proposers, are available from the District Manager at the address and telephone number listed below.

Proposers must provide three (3) copies of their proposal to Vivian Carvalho, District Manager, located at 3501 Quadrangle Boulevard, Suite 270, Orlando, FL 32817, in an envelope marked on the outside “Auditing Services- Amelia National Community Development District.” Proposals must be received by July 1, 2022, at 5:00 p.m., at the office of the District Manager. Please direct all questions regarding this Request for Proposals to the District Manager, who can be reached at (407) 723-5900.

Any protest regarding the terms of this Notice, or the proposal packages on file with the District Manager, must be filed in writing at the offices of the District Manager within seventy-two (72) calendar hours (excluding weekends) after publication of this Notice. The formal protest setting forth with particularity the facts and law upon which the protest is based shall be filed within seven (7) calendar days after the initial notice of protest was filed. District Auditing Services for Fiscal Year 2022

Instructions to Proposers

Section 1. Due Date. Sealed proposals must be received no later than July 1, 2022, at 5:00 p.m., at the offices of the District Manager, PFM Group Consulting, LLC., located at 3501 Quadrangle Boulevard, Suite 270, Orlando, FL 32817.

Section 2. Familiarity with the Law. By submitting a proposal, the Proposer is assumed to be familiar with all federal, state, and local laws, ordinances, rules and regulations that in any manner affect the work. Ignorance on the part of the Proposer will in no way relieve it from responsibility to perform the work covered by the proposal in compliance with all such laws, ordinances and regulations.

Section 3. Qualifications of Proposer. The contract, if awarded, will only be awarded to a responsible Proposer who is qualified by experience and licensing to do the work specified herein. The Proposer shall submit with its proposal satisfactory evidence of experience in similar work and show that it is fully prepared to complete the work to the satisfaction of the District.

Section 4. Submission of Only One Proposal. Proposers shall be disqualified and their proposals rejected if the District has reason to believe that collusion may exist among the Proposers, the Proposer has defaulted on any previous contract or is in arrears on any previous or existing contract, or for failure to demonstrate proper licensure and business organization.

Section 5. Submission of Proposal. Each Proposer shall submit three (3) copies of the Proposal Documents (defined below), and other requested attachments at the time and place indicated herein, which shall be enclosed in an opaque sealed envelope, marked with the title “Auditing Services – Amelia National Community Development District” on the face of it.

Section 6. Modification and Withdrawal. Proposals may be modified or withdrawn by an appropriate document duly executed and delivered to the place where proposals are to be submitted at any time prior to the time and date the proposals are due. No proposal may be withdrawn after opening for a period of ninety (90) days.

Section 7. Proposal Documents.  The proposal documents shall consist of the notice announcing the request for proposals, these instructions, the evaluation criteria and a proposal with all required documentation pursuant to Section 12 of these instructions (the “Proposal Documents”).

Section 8. Proposal. In making its proposal, each Proposer represents that it has read and understands the Proposal Documents and that the proposal is made in accordance therewith.

Section 9. Basis of Award/Right to Reject. The District reserves the right to reject any and all proposals, make modifications to the work, and waive any informalities or irregularities in proposals as it is deemed in the best interests of the District.

Section 10. Contract Award. Within fourteen (14) days of receipt of the Notice of Award from the District, the Proposer shall enter into and execute a contract or engagement letter with the District.

Section 11. Limitation of Liability. Nothing herein shall be construed as or constitute a waiver of Districts limited waiver of liability contained in section 768.28, Florida Statutes, or any other statute or law.

Section 12. Contents of Proposals. All proposals shall include the following information in addition to any other requirements of the Proposal Documents.

A. List position or title of all personnel to perform work on the District audit. Include resumes for each person listed; list years of experience in present position for each party listed and years of related experience.

B. Describe proposed staffing levels, including resumes with applicable certifications.

C. Provide three (3) references from projects of similar size and scope. The Proposer should include information relating to the work it conducted for each reference as well as a name, address and phone number of a contact person. Identify any work previously conducted for other community development districts.

D. The lump sum cost of the provision of the services under the proposal, plus the cost of two (2) annual renewals.

Section 13. Protests. In accordance with the District’s Rules of Procedure, any protest regarding the Proposal Documents, must be filed in writing, at the offices of the District Manager, within seventy-two (72) hours after the receipt of the proposed contract documents. EVALUATION CRITERIA (WITH PRICE)

1. Ability of Personnel. (20 Points)

This includes the geographic locations of the firm’s headquarters or permanent office in relation to the project; capabilities and experience of key personnel; present ability to manage this project; evaluation of existing work load; proposed staffing levels, etc.

2. Proposer’s Experience. (20 Points)

This includes past record and experience of the Proposer in similar projects; volume of work previously performed by the firm; past performance for other community development districts in other contracts; character, integrity, reputation, of respondent, etc.

3. Understanding of Scope of Work. (20 Points)

Extent to which the proposal demonstrates an understanding of the District’s needs for the services requested.

4. Ability to Furnish the Required Services. (20 Points)

Extent to which the proposal demonstrates the adequacy of Proposer’s financial resources and stability as a business entity necessary to complete the services required.

5. Price. (20 Points)

Points will be awarded based upon the lowest total bid for rendering the services and the reasonableness of the proposal.

Nassau County, Florida

Applicant: The applicant for this project is Rayonier Performance Fibers, LLC.  The applicants responsible official and mailing address are:  Mr. Mark Homans, General Manager, Rayonier Performance Fibers, LLC, Post Office Box 2002, Fernandina Beach, Florida  32035.

Facility Location: The applicant operates the existing Fernandina Beach Dissolving Sulfite Pulp Plant, which is in Nassau County at 10 Gum Street in Fernandina Beach, Florida.

Project: The applicant applied on March 23, 2021, to the Department for an air construction permit revision and a renewed Title V air operation permit.  The existing facility is an acid sulfite-based pulp mill using ammonia as a base chemical for the manufacture of dissolving pulp. This plant produces approximately 10 different grades of pulp.  The pulp produced at this plant is used in products such as plastics, photographic film, LCD screens, paints, cigarette filters, pharmaceuticals, food productions, cosmetics, and textiles.

The purpose of this permitting project is to renew the existing Title V air operation Permit No. 0890004-064-AV and issue air construction Permit No. 0890004-066-AC for the above referenced facility.  The air construction permit revision revised underlying conditions authorized in previously issued air construction permits primarily related to the following:  remove an obsolete visible emission limit for the vent gas scrubber (VGS); allow the VGS Work Practice Plant to remain on site for inspection; correct the particulate matter, carbon monoxide, and volatile organic compounds emission limits for the No. 6 Power Boiler; remove the effluent treatment systems solids as a fuel for the No. 6 Power Boiler; reduce the No. 6 Power boiler permitted capacity of 660 million British thermal units per hour based on a 24 hour average to a 4 hour block average; remove the firing of fuel oil in the Sulfite Recovery Boiler; and remove the authorization for temporary engines to be brought on and off site. This project did not cause an increase in any emission of pollutants from the facility.

Permitting Authority:  Applications for air construction permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210 and 62-212 of the Florida Administrative Code (F.A.C.).  The proposed project is not exempt from air permitting requirements and an air permit is required to perform the proposed work.

Applications for Title V air operation permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210, and 62-213, of the Florida Administrative Code (F.A.C.).  The proposed project is not exempt from air permitting requirements and a Title V air operation permit is required to operate the facility.

Notice of Intent to Issue Air Permit: The Permitting Authority gives notice of its intent to issue an air construction permit to the applicant for the project described above.  The applicant has provided reasonable assurance that operation of proposed equipment will not adversely impact air quality and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-296 and 62-297, F.A.C.  The Permitting Authority will issue a final permit in accordance with the conditions of the proposed draft air construction permit unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, F.S. or unless public comment received in accordance with this notice results in a different decision or a significant change of terms or conditions.

The Permitting Authority gives notice of its intent to issue a Title V air operation permit to the applicant for the project described above.  The applicant has provided reasonable assurance that continued operation of existing equipment will not adversely impact air quality and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-213, 62-296 and 62-297, F.A.C.  The Permitting Authority will issue a final Title V air operation permit in accordance with the conditions of the draft/proposed Title V air operation permit unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, F.S. or unless public comment received in accordance with this notice results in a different decision or a significant change of terms or conditions.

Comments:  The Permitting Authority will accept written comments concerning the draft air construction permit for a period of 14 days from the date of publication of the Public Notice.  Written comments must be received by the Permitting Authority by close of business (5:00 p.m.) on or before the end of this 14-day period to the above address and electronically to David Read at David.Read@FloridaDEP.gov.  If written comments received result in a significant change to the draft air construction permit, the Permitting Authority shall revise the draft air construction permit and require, if applicable, another Public Notice.  All comments filed will be made available for public inspection.

The Permitting Authority will accept written comments concerning the draft Title V air operation permit for a period of 30 days from the date of publication of the Public Notice.  Written comments must be received by the close of business (5:00 p.m.), on or before the end of this 30-day period by the Permitting Authority at the above address.  As part of his or her comments, any person may also request that the Permitting Authority hold a public meeting on this permitting action.  If the Permitting Authority determines there is sufficient interest for a public meeting, it will publish notice of the time, date, and location in the Florida Administrative Register (FAR).  If a public meeting is requested within the 30-day comment period and conducted by the Permitting Authority, any oral and written comments received during the public meeting will also be considered by the Permitting Authority.  If timely received written comments or comments received at a public meeting result in a significant change to the draft Title V air operation permit, the Permitting Authority shall issue a revised draft Title V air operation permit and require, if applicable, another Public Notice.  All comments filed will be made available for public inspection.  For additional information, contact the Permitting Authority at the above address or phone number.

Petitions:  A person whose substantial interests are affected by the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S.  Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the Public Notice or receipt of a written notice, whichever occurs first.  Under Section 120.60(3), F.S., however, any person who asked the Permitting Authority for notice of agency action may file a petition within 14 days of receipt of that notice, regardless of the date of publication.  A petitioner shall mail a copy of the petition to the applicant at the address indicated above, at the time of filing.  A petition for administrative hearing must contain the information set forth below and must be filed (received) with the Agency Clerk in the Office of General Counsel, 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 32399-3000, Agency_Clerk@dep.state.fl.us, before the deadline.  The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that persons right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it.  Any subsequent intervention (in a proceeding initiated by another party) will be only at the approval of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C.

A petition that disputes the material facts on which the Permitting Authoritys action is based must contain the following information:  (a) The name and address of each agency affected and each agencys file or identification number, if known; (b) The name, address, any email address, telephone number and any facsimile number of the petitioner; the name, address, any email address, telephone number, and any facsimile number of the petitioners representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioners substantial interests will be affected by the agency determination; (c) A statement of when and how each petitioner received notice of the agency action or proposed decision; (d) A statement of all disputed issues of material fact.  If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the agencys proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agencys proposed action including an explanation of how the alleged facts relate to the specific rules or statutes; and, (g) A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the agency to take with respect to the agencys proposed action.  A petition that does not dispute the material facts upon which the Permitting Authoritys action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C.

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authoritys final action may be different from the position taken by it in this written notice of Intent to Issue Air Permit.  Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above.

Extension of Time: Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Departments action may also request an extension of time to file a petition for an administrative hearing.  The Department may, for good cause shown, grant the request for an extension of time.  Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@dep.state.fl.us, before the deadline for filing a petition for an administrative hearing.  A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon.

Objections:  Finally, pursuant to 42 United States Code (U.S.C.) Section 7661d(b)(2), any person may petition the Administrator of the EPA within 60 days of the expiration of the Administrators 45-day review period as established at 42 U.S.C. NASSAU COUNTY has an allocation of approximately $350,000 in affordable housing dollars available through the State Housing Initiatives Partnership (SHIP) Program.

ELIGIBLE APPLICANTS

Twenty percent (20%) of the 2021-22 SHIP funding has been designated to serve persons with Special Needs as defined in F.S. 420.004 (13) “Persons with special needs” means an adult person requiring independent living services in order to maintain housing or develop independent living skills and who has a disabling condition; a young adult formerly in foster care who is eligible for services under F.S.. 409.1451(5); a survivor of domestic violence as defined in F.S. 741.28; or a person receiving benefits under the Social Security Disability Insurance (SSDI) program or the Supplemental Security Income (SSI) program or from veterans’ disability benefits to meet set aside requirements. A child receiving SSDI qualifies the household for assistance.

PROGRAMS FUNDED FOR THE 2021-2022 FUNDING PERIOD include:

• Home Modification and/or Rehabilitation Loans for existing homeowners

(Grants are no longer available for assistance).

• Purchase Assistance with or without Rehabilitation for buyers who do not currently own a home.

Repair costs cannot exceed $5,000.

• Purchase Assistance for the purchase of new or existing manufactured home/land packages

that are less then 20 years old (maximum award $25,000)                

Applications will be available Friday, July 1, 2022. Applications will not be accepted after funds are exhausted. Applications will be processed “first come, first qualified, first eligible” with a priority given to Special Needs applicants.

Eligible Applicants for Home Modification or Rehabilitation: Assistance is allocated up to $85,000. A note and mortgage must be signed, and the deferred payment loan will be forgiven after seven (7) years. Home Rehabilitation projects estimated to require more than $85,000 to meet local building code standards will not be eligible. Applicants must qualify under extremely low (30% of median income), very low (50% of median income), or low (80% of median income) income levels and must occupy the property as their principal residence. Assistance is provided on a “first come, first qualified, first eligible” basis. Homeowner insurance is required during the life of the loan (seven years) however, a portion of the SHIP award can be used to purchase the first year of insurance. The following 6 years will be the responsibility of the homeowner. Mobile homes, rentals and condominiums are not eligible for modification or rehabilitation. Applicants must not be delinquent on any real property tax owed to Nassau County, must occupy the property as their principal residence and must have clear title (ownership) to the property. Eligible applicants can only receive assistance through the SHIP Program once in a 10-year period.

Assistance Limits for New Home Purchases: Currently assistance limits are 20%, 25% and 30% of the sales price of a home and the amount of funding is dependent on the income level of the applicant’s household. The maximum deferred loan is $102,747 and the maximum price of a home for SHIP eligibility is 90% of the Median Home Sold Price for the last 12 months not to exceed $359,263.80 for applicants meeting income limits. Funds may be used for closing costs, first mortgage down payment or a combination of both needs. Up to $5,000 can be used for home repair costs such as roof repairs, window replacement, plumbing, electrical etc. The buyer must occupy the home for ten (10) years for the SHIP loan to be satisfied. A pre-qualification letter from your primary mortgage lender is required for submission of your application.

Assistance Limits for Manufactured Home Purchases: Assistance limits are $25,000 with a maximum purchase price of 90% of the Median Home Sold Price for the last 12 months not to exceed $359,263.80 for applicants meeting the income limits. Funds may be used for closing costs, first mortgage down payment or a combination of both. The buyer must occupy the home for ten (10) years for the SHIP loan to be satisfied. A pre-qualification letter from your primary mortgage lender is required for submission of your application. Only new and existing manufactured land/home packages less than 20 years old are eligible for assistance.

PAB CASE 2022-0021: CITY OF FERNANDINA BEACH REQUESTS LAND DEVELOPMENT CODE TEXT AMENDMENTS mINOR AMENDMENTS TO ADDRESS ERRORS, OMISSIONS AND CORRECTIONS INCLUDING SECTION 1.07.00 to amend definitions for balcony, PORCH, and shade tree; and to modify Standards for Lot Design by striking water bodies as impervious surfaces in section 4.02.01(D); and amending TABLE 4.02.01(J) Design Standards for Lots to add note 4.02.01(J)(7) requirement of a permit for concrete or asphalt installation more than 150 square feet; and amending section 4.02.03(A)(5) Standards for Buildings and Building Placement to add subsection 4.02.03(A)(5)(a) to address side and front yard setback requirements for balconies; and amending section 4.02.03 (A)(7) deck setback requirements for side and rear yards; and amending section 4.03.03(6)(A) 8th Street Small Area Design Standards to address fence material requirement for properties fronting 8th Street and to add subsection 4.02.03(A)(I) providing wood and vinyl fence material allowance for all other properties not fronting 8th Street, within MU-8 zoning; and amending section 5.01.11(F)(2) and 5.01.11(F)(3) Swimming Pools and Pool Enclosures to modify minimum side and rear setback requirements; and amending section 6.02.24 Mobile FOOD Vending “Food Truck” Parks to add Subsection 6.02.24(A)(1) Directing food truck compliance with all provisions of applicable Florida Statutes and Florida Administrative Code, and amending section 6.02.24 to include references to Florida Statutes and Florida Administrative Code; and amending section 7.01.01(e) ACCESS AND DRIVEWAY DESIGN REQUIREMENTS; and modifying section 7.01.02(C) Streets and Rights-of-Way to include amended street number sign requirements, and by AMENDING SECTION 7.01.02(C) TO strikE subsection 7.01.02(C)(2); and modifying TABLE 7.01.04(A) Parking Space Requirements by striking erroneous reference to section 4.03.03 in footnote 2; and amending section 7.01.08(B) Visibility at Intersections directing consistency with Florida Department of Transportation (FDOT) Design Manual and by striking subsection 7.01.08(B)(1); and modifying Standards for Amelia River Waterfront Community Redevelopment Area by striking erroneous reference to Section 3.01.03(J) as contained in section 8.01.02(D)(1); and amending section 8.01.01.02 (H). Specific Requirements within the OT-1 and OT-2 Zoning Districts to address inconsistency in height requirements for accessory dwellings within the OT-1 and OT-2 Zoning Districts; and amending section 9.01.01 Appointment, Term of Office, and General MEMBERSHIPS Requirements and SECTION 9.01.02 ATTENDANCE AND AMENDING SECTION 9.01.03 OFFICERS AND COMMITTEES amending section 9.01.04 Removals and Vacancies to provide consistency with Municipal Code Standards as amended in August 2021 AND MODIFYING SECTION 10.02.01 VARIANCES GENERALLY TO ALIGN WITH THE CURRENT BUILDING HEIGHT RESTRICTION LANGUAGE IN SECTION 4.02.03.

A Leon County circuit judge Tuesday refused to put on hold a lawsuit filed by Florida State University against the Atlantic Coast Conference, as a big-money battle between the university and its lo
