PUBLIC MEETINGS OF THE CITY OF FERNANDINA BEACH CANVASSING BOARD FOR THE DECEMBER 8, 2020 RUNOFF ELECTION

All meetings of the City of Fernandina Beach Canvassing Board (Canvassing Board) are open to the public and will be conducted at the James S. Page Governmental Complex in the Canvassing Board Room located at 96135 Nassau Place, Yulee, Florida 32097.  Public inspections of sealed VBM ballots will be held in the Supervisor of Elections Office located in Suite 3 in the Complex.

The Canvassing Board will convene at 1:00 p.m. on December 2, 2020 for the public pre-election testing of the automatic voting tabulation equipment to be used in the December 8, 2020 Runoff Election and to perform any other duties as prescribed by law. 

Sealed Vote by Mail (VbM) ballots received prior to 2:00 p.m. on December 8, 2020 will be available for public inspection from 2:30 p.m. – 3:00 p.m. on December 8, 2020.  Those VbM ballots will be canvassed, opened and tabulated at the Canvassing Board meeting to convene at 3:00 p.m. on December 8, 2020; however, the results will not be generated at that time. Persons wishing to inspect sealed VbM ballots received after 2:00 p.m. through 7:00 p.m. on December 8, 2020 must be present during the Canvassing Board meeting, until the last VbM ballot is presented for canvassing. Those ballots will be canvassed, opened and tabulated throughout the Canvassing Board meeting to convene at 3:00 p.m. on December 8, 2020. The results of the VbM ballots, provisional ballots and precinct results will be generated after 7:00 p.m. on December 8, 2020.  If there are no additional provisional ballots or vote by mail cure affidavits to be canvassed and if there is no recount ordered, the Canvassing Board will certify the official results at this meeting.

The Canvassing Board will convene at 12 noon on December 10, 2020 to conduct a recount, if ordered.  This meeting will only be held if a recount is ordered.

The Canvassing Board will convene at 4:00 p.m. on December 10, 2020 to canvass, open and tabulate any remaining provisional ballots, cure affidavits for provisional ballots and VbM ballots, if necessary, certify the unofficial results, and perform any other duties as prescribed by law for the December 8, 2020 Runoff Election. This meeting will only be held if there are any provisional ballots or vote by mail cure affidavits to canvass, open and tabulate.

The Canvassing Board will convene at 10:00 a.m. on December 11, 2020 to conduct the post-election audit of the voting system and perform any other duties as prescribed by law. 

If it becomes necessary for the Canvassing Board to suspend or recess a meeting publicly noticed for a period lasting more than 60 minutes, a notice will be posted at www.fbfl.us with the anticipated time and date at which the board expects to reconvene.  If the Board does not reconvene at the specified time, the board will provide at least 2 hours’ notice, which will be posted on www.fbfl.us, before reconvening. 

Section 101.68(2)(c)4, Florida Statutes, provides if any elector or candidate present believes that a VbM ballot is illegal due to a defect apparent on the voter’s certificate or the cure affidavit, he or she may, at any time before the ballot is removed from the envelope, file with the canvassing board a protest against the canvass of that ballot, specifying the precinct, the ballot, and the reason he or she believes the ballot to be illegal. A challenge based upon a defect in the voter’s certificate or cure affidavit may not be accepted after the ballot has been removed from the mailing envelope.

In accordance with the Sunshine Law of Florida, all Canvassing Board meetings are open to the public.

Section 286.0105, Florida Statutes, provides that if a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

NOTICE OF INTENT

TO ISSUE PERMIT

The Department of Environmental Protection gives notice of its intent to issue a permit to WestRock CP, LLC., Daniel Rowland, General Manager, P.O. Box 2000, Fernandina Beach, Florida 32034, to operate WestRock CP, LLC - Fernandina Beach Mill, which is an existing 37.5 million gallons per day (MGD) industrial wastewater treatment facility which would discharge 30 MGD (annual average) of process wastewater and 7.5 MGD stormwater to Amelia River (Class III Marine water; WBID# 2124).  The WestRock Fernandina Beach Mill produces unbleached Kraft linerboard with the primary SIC code of 2631, Paperboard Mills.  The production consists of the following general steps: wood preparation, pulping, pulp processing and chemical recovery, and paper and paperboard manufacturing that contribute to the wastewater. The facility is located at latitude 30° 40' 47.41" N, longitude 81° 27' 21.7" W, 600 North 8th Street, Fernandina Beach, Florida 32034 in Nassau County. The Department has assigned permit file number FL0001104-013-IW1S to the proposed project.

The intent to issue and application file are available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department's Northeast District Office, 8800 Baymeadows Way West, Suite 100, Jacksonville, Florida 32256-7577, at phone number (904)256-1700.

NOTICE OF RIGHTS

The Department will issue the permit unless a petition for an administrative hearing is timely filed under Sections 120.569 and 120.57, F.S., before the deadline for filing a petition. On the filing of a timely and sufficient petition, this action will not be final and effective until further order of the Department. Because the administrative hearing process is designed to formulate final agency action, the hearing process may result in a modification of the agency action or even denial of the application.

Petition for Administrative Hearing A person whose substantial interests are affected by the Department's action may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S. Pursuant to Rules 28-106.201 and 28-106.301, F.A.C., a petition for an administrative hearing must contain the following information:

(a) The name and address of each agency affected and each agency's file or identification number, if known;

(b) The name, address, any e-mail address, any facsimile number, and telephone number of the petitioner, if the petitioner is not represented by an attorney or a qualified representative; the name, address, and telephone number of the petitioner's representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner's substantial interests will be affected by the agency determination;

(c) A statement of when and how the petitioner received notice of the Department's agency decision;

(d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate;

(e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the agency's proposed action;

(f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agency's proposed action, including an explanation of how the alleged facts relate to the specific rules or statutes; and

(g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency's proposed action.

The petition must be filed (received by the Clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@FloridaDEP.gov. Also, a copy of the petition shall be mailed to the applicant at the address indicated above at the time of filing.

Time Period for Filing a Petition Petitions filed by any persons other than the applicant, and other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the notice or within 14 days of receipt of the written notice, whichever occurs first. The failure to file a petition within the appropriate time period shall constitute a waiver of that person's right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Extension of Time

Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department's action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@FloridaDEP.gov, before the deadline for filing a petition for an administrative hearing. This public notice is to solicit Pre-Qualification applications from Bidders as per the State Requirements for Educational Facilities (SREF, 2014, Revised 11-14), Chapter 4.1 (1) (a) and Nassau County School District Administrative Rule 7.68 as follows:

(1) Pre-qualification of General Contractors for Educational Facilities Construction.  A Board shall pre-qualify contractors for a one-year period or for a specific project.  The intent of this section is to prescribe uniform requirements for pre-qualification of contractors.

(a) Criteria.  Contractors shall be pre-qualified by a board based on the following criteria and such other criteria as the board may adopt.

1. Proof that the contractor holds a State of Florida contractor’s license, which authorizes the contractor to supervise the work within the scope of the construction project.

2. Evidence that the applicant has financial resources to start up and follow through on projects and to respond to damages in case of default as shown by written verification of bonding capacity equal to or exceeding the amount of any project for which the contractor seeks pre-qualification.  The written verification must be submitted by a licensed surety company rated excellent (A-or better) in the current A.M. Best Guide and qualified to do business within the state.  In the absence of such written verification, the board may require the applicant to submit any audited financial information necessary to evaluate an applicant’s financial ability to perform the project and to respond to damages in the event of default.

3. Evidence of experience with construction techniques, trade standards, quality workmanship, project scheduling, cost control, management of projects, and building codes for similar or less cost or scope projects as shown by the successful completion within the past five (5) years of at least two (2) other projects of similar size.

4. Evidence of satisfactory resolution of claims filed by or against the contractor asserted on projects of the same or similar size within the five (5) years preceding the submission of the application.  Any claim against a contractor shall be deemed to have been satisfactorily resolved if final judgment is rendered in favor of the contractor or any final judgment rendered against the contractor is satisfied within ninety (90) days of the date the judgment becomes final.

5. Type of work for which the contractor is licensed.  Evidence of timely completion of projects of similar scope and size.  Include any liquidated damages that may have been or could have been assessed on these projects.

John M. Drew, Tax Collector, has received the 2020 Nassau County Tax Roll as certified by A. Michael Hickox, Property Appraiser. The Tax Roll is now open for payment of 2020 taxes via the internet at www.nassautaxes.com by E-check (no service charge) or by Visa, MasterCard, Discover and American Express (service charges apply). Payments are also accepted via U.S. Mail and at the office locations listed below.
The tax roll includes real estate taxes, tangible personal property taxes, centrally assessed items and special assessments listed as ad valorem taxes and non-ad valorem assessments.
