Intruder shot in Yulee home invasion

Updated Wednesday with intruder's name.

According to Nassau County Sheriff Bill Leeper, Timothy William Rasbeary, 72, died from a pistol wound early Monday morning after Rasbeary allegedly “busted out” the front door of a Yulee house where the homeowner, Christopher E. Kuches, was sleeping on the couch. Kuches pulled out a pistol and shot the intruder.

“NCSO received a call this morning around 6:30 a.m. in reference to a shooting. Apparently an adult male pushed in the front door of a home… The homeowner woke up and observed the male inside his residence and shot him one time with a handgun causing fatal injuries. There were two other people inside the residence at the time (both sleeping): an adult female, an acquaintance, and a small child, which (is) the son of the homeowner. The shooting is still under investigation at this time,” wrote Leeper in an email to the News-Leader on Monday.

Leeper told a Jacksonville television station that, as of Monday, there was no evidence of wrongdoing on the part of Kuches, who lives at 85642 Miner Road. Leeper added that he did not know if Kuches knew the intruder, now identified by the NSCO as Rasbeary.

The case report from a responding deputy says that when the deputy arrived, the dead man was in the house. “Upon making entry in to the house I found the subject deceased on the floor with an apparent gun shot wound. … The scene was then secured and handed over to (Criminal Investigative Division) upon their arrival.”

Kuches was released to detectives.

Asked if it is the right thing to do to shoot someone breaking into your house, Leeper said, “Certainly people have guns in their homes to protect themselves and their property. If you break into a home you might expect to get shot, so I would suggest not to break into homes.”
